Published the new Royal Decree 1112/2018, 7 September, on the web accessibility and applications for mobile devices in the public sector

This new Royal Decree transposed to Spanish legislation the directive (HAT) 2016/2102 of accessibility of websites and mobile applications of the public sector.

Hoy entran en vigor la mayoría de las provisiones del nuevo Real Decreto 1112/2018, de 7 de septiembre, sobre accesibilidad de los sitios web y aplicaciones para dispositivos móviles del sector público (Opens in new window) .

This Royal Decree, adopted at the proposal of the ministries of Territorial Policy and Public Function, economy and Company, health, consumption and Social welfare, transposed into Spanish law Directiva (UE) 2016/2102 del Parlamento Europeo y del Consejo, de 26 de octubre de 2016, sobre la accesibilidad de los sitios web y aplicaciones para dispositivos móviles de los organismos del sector público (Opens in new window) .

The aforementioned Royal Decree guarantees equality and non-discrimination of access to all citizens, especially for people with disabilities and the elderly.

El Real Decreto va a tener un impacto positivo en materia de accesibilidad universal de las personas con discapacidad, con la eliminación de barreras que facilitará y garantizará el ejercicio de su derecho al acceso a las tecnologías, así como su derecho a relacionarse con las Administraciones públicas.

Asimismo, facilitará que las personas mayores con posibles limitaciones físicas derivadas de la edad (dificultades de visión, distinción de colores, dificultades de audición o de movilidad, entre otras) puedan hacer un mejor uso de los sitios web y aplicaciones móviles del sector público.

This ensures the exercise of the right of all people to access to the technologies, products and services related to the information society and media, as well as the right to interact with public administrations through these means.

The Royal Decree covers all websites and mobile applications of the public sector, since those belonging to the administrations, courts and police services to hospitals, universities and public libraries, making them accessible to all citizens, especially those with hearing difficulties, visual or functional.

In this way, the new Royal Decree replaces and improves the conditions that were already demanding the portals of public administrations since 31 December 2008 Royal Decree 1494/2007 (Opens in new window) .

The most significant changes which introduces are as follows:

  • Equal accessibility requirements Spaniards to European harmonised standard setting at the end of this year 2018. This standard will be based on the new version of the standard in 301 549 “ Accessibility requirements of products and services TIC applicable to public procurement in Europa ” which in turn is linked with the new WCAG 2.1 .
  • The inclusion of mobile applications developed by public administrations which should be accessible by 23 June 2021.

  • Captures the forecasts for the regular monitoring of the implementation of the Royal Decree through decentralized management. For this, each entity obliged to determine the " unit responsible for accessibility " which will coordinate and implement forecasts, and will be the channel information to the agency for monitoring and reporting.
  • In each portal there shall be a statement of accessibility, depending on the model to be established at European level, a mechanism for error reporting and apply to demand content not accessible. In Addition there will be a complaints mechanism available to all interested persons.
  • Moreover defines a procedure for tracking and reporting that will lead the ministry of Territorial Policy and Public Function and for its execution with the collaboration of all public administrations. Such monitoring must meet the requirements imposed by the European commission through the corresponding implementing acts that will be available before the end of this year.
  • Se realizarán reportes públicos a la Comisión Europea cada 3 años del estado de aplicación de la directiva conforme a los correspondientes actos de ejecución que establecerá la Comisión Europea antes de finalizar este año. El primero de estos reportes se realizará antes del 23 de diciembre de 2021.
  • Provides a mechanism to allow users to communicate to the public sector agency any possible breach of accessibility requirements established.
  • Allows you to apply to persons interested information on content that are excluded from the scope of this Royal Decree or exempted from accessibility requirements.
  • Extiende la aplicación de los requisitos de accesibilidad web a los portales que reciben financiación pública para su mantenimiento, y aquellos que proveen servicios públicos mediante algún régimen contractual con las Administraciones Públicas.

Para ayudar al cumplimiento de todas estas medidas será esencial el papel que desempeñarán the units responsible for accessibility, que serán las encargadas de garantizar el cumplimiento de los requisitos de accesibilidad de los sitios web y aplicaciones para dispositivos móviles dentro de su ámbito competencial. Deberán velar por su cumplimiento desde todos los ámbitos de la organización, tanto técnicos como funcionales e involucrar a todos los actores necesarios: departamentos tecnológicos, responsables de edición de contenidos, responsables de publicaciones, responsables de comunicación y prensa, responsables de formación, etc.

Entry into force

The royal decree enters into force on the day following that of its publication in the “ Official Newsletter of the state ” with the following exceptions:

  • For the websites, provisions under Articles 10.2.b), 12 and 13 apply the year of the entry into force of this Royal Decree, and the two years for the websites already issued.
  • All provisions relating to applications for mobile devices apply from 23 June 2021.

Currently, the member states and the European commission are in the final phase of the definition of the methodology of monitoring and reporting, models declaration of accessibility and the definition of the standard harmonised.
