The Official Journal of the European Union has published Regulation (HAT) 2016/679 the European Parliament and advice, 27 April 2016, concerning the protection of individuals with regard to the treatment of personal data and on the free movement of such data and repealing Directive 95/46/CE (general Rules of data protection).
The Regulation updates definitions and principles relating to the processing of personal data and their lawfulness; treats conditions relating to consent and, in particular, the consent of the child; comes special categories of personal data; embodies the rights of the individual; sets the obligations of those responsible and responsible for the treatment of data; includes the figure of the delegate of data protection; tries codes of conduct and certification, transfers of personal data to third countries or international organisations, the independent regulatory authorities, cooperation, the European committee of data protection; develops resources, responsibilities and sanctions; as well as the specific situations of treatment; empowers the commission to delegated and implementing acts, and supersedes the directives 95/46/CE and 2002/58/CE.
There have also published two Directives:
- Directive 2016/680 concerning the protection of individuals with regard to the treatment of personal data by the competent authorities for the purpose of prevention, investigation, detection and prosecution of criminal offences or execution of criminal sanctions, and the free movement of such data and repealing the framework decision 2008/977/JAI of the board.
- Directive 2016/681 concerning the use of data Name Record of passengers (PNR) for the prevention, detection, investigation and prosecution of terrorism and serious crime.
