The Council of ministers has approved the referral to the courts of the draft law amending the law on reuse of public sector information, from 16 november 2007, in order to incorporate developments which introduces a Community directive of 26 june 2013. (Opens in new window)

Other developments have introduced, in the project, which has the favourable report of the council of state, underlines the extension of the reuse of public sector information in three types of cultural institutions: libraries, archives and museums. Also provides that, if a charge for reutilization of documents, should be limited to the marginal costs incurred for the reproduction, provision and dissemination.

It also encourages the use of open licensing, enforcing the minimum possible restrictions on reuse.
Moreover, the state secretariat for Public Administrations, in coordination with the secretariat of state of telecommunications and information society, submitted every three years the european commission a report on the information available for reuse.

The exclusive agreements of reuse in favour of third parties will be signed by three years, exceptionally, when necessary for the provision of a public service. Furthermore, the exclusive arrangements for the digitisation of cultural resources will have a duration of ten years.
In addition, irrespective of the content of the community directive, incorporating the centre of Sociological Research (CIS) to the process of re-use of information, with a specific database in the case of quantitative surveys.
